1. Who are we?

When we use the terms "Getcaller," "our," "we," or "us," we are referring to "CloudLadder OU," which serves as the data controller. This Privacy Policy and the Clarification Statement Regarding the Processing of Personal Data ("Privacy Policy") applies to all of our applications, services, features, software, and website (collectively referred to as "Services"), unless stated otherwise

This Privacy Policy outlines how we use your personal data and the measures we take to keep it secure and confidential. It should be read in conjunction with our Terms of Service.

2. How do we collect your personal data?

We may collect personal data from you electronically through our websites and mobile applications operated by or on behalf of Getcaller.

3. What personal data or permission do we collect/ask?

We gather personal data about you when you register for and/or use our Services. For instance, we may collect your name, contacts, internet status, payment details, phone number, or email address. However we ask permission web camera to scan qr code and ask contact read and write permission. Users can decline this permission. But then maybe you can not use some of our services.

It is your responsibility to verify and ensure that all information, data content, materials, or data you provide to us are correct, complete, accurate, and not misleading.

In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID (IMEI), the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

The App Collects Contact List Data

To use our services effectively, you may need to enable certain features on your phone. By using GetCaller, you agree to share the names, numbers, and details in your contact list, which we may access and collect. This allows us to detect spam calls, provide caller ID features, improve your experience, and offer additional functionality based on your contacts. Also Getcaller provides you with insights on how your phone number has been saved by others. We may periodically sync this data. If you choose not to enable these features or grant access, some functions may not be available.

How the Data is Uploaded (to https://getcaller.net)

During registration, we give you the option to share your contact list with us. GetCaller enables you to share either your entire contact list or select specific contacts (the full list is selected by default if no choice is made).
You can choose not to share your contacts. To do so, simply deny the app contact access or deselect all contacts in the designated contact-sharing section. This decision is entirely up to you.

Once the contact list data is collected, it is securely transmitted to our servers at https://getcaller.net over an encrypted connection. The data is uploaded to ensure that you can access it from our servers and view the insights provided by our service. We use industry-standard encryption to protect your data during transmission and while it is stored on our servers.

User Consent

By using the GetCaller app and providing access to your contact list, you consent to the collection, upload, and storage of this data for the purposes outlined in this privacy policy. If you do not consent to this, you can choose not to grant the app access to your contacts.

Contact write Permissions

When you search for a phone number within our application, you will be navigated to the profile page. On this page, if you have granted the app permission to access your contacts, you can add the number to your contact list by using the "Add" button.

4. How and for what purposes do we use your personal data?

Subject to obtaining your prior consent and considering your preferences in the application settings, we may use your personal data in the following ways. To allow you to access and use the Services:
To create user accounts and profiles;
To identify phone numbers;
To provide you with the appropriate versions of our applications;
To fulfill any applicable contractual obligations; and
To send you service-related communications, such as confirmations, technical notices, updates, security alerts, support or administrative messages, and notifications about profile visits, directory searches, and updates on whether profile-related tags have been viewed or new tags have been added to the Getcaller directory. In additionaly we collect datas for App functionality, Analytics, Fraud prevention, security, and compliance, Advertising or marketing, Personalization and Account management.

Purpose of Collecting Contacts

The primary purpose of collecting your contact list data is to offer the core feature of GetCaller, which is to show how other users have saved your phone number in their contacts. The data allows us to match your contacts with our database and provide this information to you. No additional use of your contact list data is made beyond this purpose.

And also by accessing the user`s contacts, GetCaller will identify and show you which individuals in the user`s contact list are also using the Getcaller app.

Usage collected Contacts

The contact information collected will be used solely for the purpose of identifying mutual GetCaller users and will not be shared with third parties without explicit consent from the user. GetCaller will identify which individuals in the user`s contact list are also using the GetCaller app. This data will be securely stored and processed in accordance with our privacy practices to ensure the protection of your personal information.

Third-Party Information

We may receive information about you from other users. For instance, when users utilize our Services, they might provide us with your phone number, name, and other details (such as information from their mobile address book or comments left in a special field on your personal profile), just as you might provide similar information about them.

We require all users to have the legal rights to collect, use, and share your information before providing it to us. We are not responsible for the disclosure of information (including personal data) due to users' actions while using the Services. If a comment on a user's personal profile violates the Getcaller Code of Conduct, the user can request its removal through our customer support. Such requests, regardless of the reason, will be reviewed and decided upon based on the Privacy Policy, Terms of Use, Code of Conduct, and the applicable laws in the country where the Services are used. We will strive to respond promptly to these requests, with a response time not exceeding 30 days from the date the request is received.

5. Who do we share your personal data with?

When you use any of our Services, we may disclose your personal data to the following parties:

a) To any competent law enforcement body, regulatory authority, government agency, court, or other third party where we believe disclosure is necessary.

b) To any other person with your explicit consent for the disclosure.

c) To third-party service providers and partners who deliver specific services on our behalf, such as data storage or processing services, including those located outside your territory, and assist us in analyzing the performance of our Services. These third parties access your personal data strictly for performing these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

d) Information regarding payment and payment methods (including payment institutions, PSPs, payment brokers, payment service providers, and technical integrators) for the Services, including those outside your region, is collected for performing, developing, and analyzing the core service we provide under our Terms of Service agreement. This payment information is shared with our business partners as third parties, enabling our Company, as the data controller, to fulfill its legal obligations.

e) Getcaller may share your personal information with third-party service providers that assist in operating the Service, such as hosting and customer support providers, with the user's consent. The Company may also share your personal information to meet legal obligations or enforce the Terms of Service.

Additionally, your personal data may be transferred abroad and processed by our Group Companies, third-party service providers, and partners located outside your country, based on your consent. By accepting our Terms of Service, you consent to the processing and transfer of your personal data abroad. If you do not consent to this, you may choose not to use our Services.

6. What cookies do we use?

A cookie is a small text file placed on your computer or device. We and our partners use cookies and similar technologies to deliver and personalize our Services, analyze usage, target advertisements, and prevent fraud. You can disable cookies through your browser or device settings; however, doing so may cause some parts of our Services to not function properly.

8. How long do we keep your personal data?

Unless a longer retention period is required or permitted by law, we may keep your personal data only as long as reasonably necessary to fulfill the purposes outlined in this Privacy Policy and for our legitimate business purposes, such as complying with legal and regulatory obligations, resolving disputes, and enforcing our agreements. We may retain your information for up to three (3) years after we become aware that you have stopped using our Services. Additionally, we may keep non-personally identifiable information for backups, archiving, fraud prevention, analytics, or other legitimate reasons. For example, certain data may be retained for up to three (3) months before being deleted and made inaccessible.

Unless otherwise stated in this Privacy Policy, the personal data you provide will be stored only as long as necessary for us to fulfill our obligations in providing the Services.

Your consent to provide us with your personal data remains valid for the duration necessary to achieve the purposes outlined in this Privacy Policy and this clause.

9. Age limits

We do not intentionally collect or solicit personal data from individuals under the age of 18, nor do we target interest-based advertising toward them or knowingly allow them to use our Services. If you become aware that your child has provided us with personal data without your consent, you can notify our customer support. If we discover that we have collected personal data from children under 18, please contact us at the applicable email [email protected] (please include your name, mailing address, and email address) we will promptly take steps to delete that data as soon as reasonably possible.

10. Managing your Privacy preferences and your personal data rights

Delete my account and unlist me

We want you to have control over your privacy preferences, so we have developed various in-app features and a dedicated Privacy Management Centre to make it as easy as possible. You can request the permanent deletion (and also unlist) of your account by using the "Delete my account and unlist me" feature in the app. When a user uses this feature, their information immediately will appear as "unlisted" during other users` searches, with no details provided. Your account will be deleted within 30 days. (However, we may still hold certain information to comply with regulatory requirements.) If the user login to the mobile application within this period, the deletion process will be cancelled, and their data will not to deleted, and also their unlist request will be cancelled immediately

11. Complaints

If you have a complaint about the use of your personal data, you can contact our customer support team. Or you can use our "Delete my account and unlist me" feature which is in Getcaller app to your information unlist or deleted.

12. Changes to this Privacy Policy

We reserve the right to amend or modify this Privacy Policy at any time, and any changes will be published on our Services. The date of the latest revision will be displayed on this page. If we make significant changes to this Policy, we may also notify you through other means, such as sending an email. Where required by law, we will obtain your consent for these changes. If you do not agree with any changes, please discontinue using our Services.

13. Your Consent

By using the Application, you are giving your consent to the Service Provider processing of your information as set forth in this Privacy Policy now and as amended by us. "Processing" means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information.
